Trade marks

What kind of data does Swissreg contain?

  • Pending applications: New applications are usually available in the database within eight working days of receipt.
  • Cancelled applications: Swissreg includes all applications which were cancelled after July 2006.
  • Active trade marks: All valid registered trade marks are included in Swissreg.
  • Cancelled trade marks: Swissreg includes all trade marks which were cancelled after July 2006.

International registrations with effect in Switzerland

Although Swissreg includes all Swiss trade marks and applications, it does not include international trade marks with effect in Switzerland. International trade marks are registered at the World Intellectual Property Organization (WIPO) (www.wipo.int) in Geneva. The online register can be searched for free using WIPO’s Madrid Monitor (www.wipo.int/madrid/monitor/en).

Features specific to applications

If you call up the specific details of a registered trade mark from a results list (“detailed view”), then not only the current status of the trade mark is displayed, but also the history including all changes since its registration. However, the detailed view for applications only shows the current status but not the history.

Carrying out a search for applications is the same as for registered trade marks. However, no applications are displayed with searches for publications or when displaying the results in the “publication view”.

Trade mark numbers/renewals

Trade marks can be renewed once their protection has expired; in this instance, the original trade mark number is retained. Under previous legislation, however, trade marks that were renewed were issued with a new trade mark number and the old number was permanently erased. These cannot be found in Swissreg.

Patents

What kind of data does Swissreg contain? What types of data are not included?

  • Swiss and European patents with effect in Switzerland and Lichtenstein are available in Swissreg after they have been granted. This includes patents which are in force as well as patents which have been cancelled.
  • All Swiss patents with a filing date from January 1978 are included. Some earlier patents are also included.
  • European patents (EP patents) from the number EP 0 00 000 001 are included.
  • Swiss patent applications filed on or after 01.07.2008 are published 18 months after the date of filing, or if priority is being claimed, 18 months after the priority date and are then included in Swissreg. Swiss patent applications with a filing date prior to 01.07.2008 are not be published, with the exception of PCT applications from 01.07.2008, which are published immediately after entering the national phase.
  • European patent applications with effect in Switzerland and Liechtenstein are not included in Swissreg before the patent has been granted.

Options and restrictions when searching in Swissreg

Swissreg allows you to perform online searches of published Swiss patent applications and patents which have been granted with effect in Switzerland and Lichtenstein and which are entered in the IPI’s registers.

For a complete and reliable basis for decisions, for example on the state of the art, we recommend that you have a professional search carried out by the IPI or a private search provider.

International patent (PCT) applications designating Switzerland and Liechtenstein

As of 1 July 2008, PCT patent applications designating Switzerland and Liechtenstein are included in Swissreg only if the patent application has entered the national phase or if the corresponding European patent has been granted through the European Patent Office. International PCT applications are listed on the World Intellectual Property Office (WIPO) website once they have been published: http://www.wipo.int/pctdb/en/

Links to other databases

For every patent in the results list and in the detailed view, there is a link to Espacenet (European Patent Office) where you can find information in addition to what is relevant for Switzerland and Liechtenstein. This information is not administered by the IPI.

Links to patent documents

For each patent granted and each published patent application, a document including the technical specifications (description of the invention, patent claims, abstract and possibly illustrations) is available. These documents can be viewed using the links available in the results list and the detailed view.

Publication dates

The publication dates can only be searched from the electronic publication date of 01.07.2018 onwards. Older publication dates are only shown in the detailed view with the publication number and year, but cannot be searched in this form. Searching for documents published before 01.07. 2008 can be done using the grant date or cancellation date in the advanced search mode.

Display of a maximum of 500 results

Please note that no more than 500 results will be displayed. If your search results in more than 500 matches, a simplified result list will be shown. If your search results in more than 10,000 matches, then 10,000 random records will be displayed.

SPCs

What kind of data does Swissreg contain? What types of data are not included?

Supplementary protection certificates (SPCs) with and without an extension, as well as paediatric supplementary protection certificates (paediatric SPCs) based on Swiss and European (basic) patents with effect in Switzerland and Liechtenstein are accessible in Swissreg as soon as the application has been published. This includes both valid and cancelled SPCs and paediatric SPCs. Unpublished SPC and paediatric SPC applications are not available in Swissreg.

Swissreg is a tool for carrying out online searches for published, granted and cancelled SPCs and paediatric SPCs that are entered in the registers of the IPI.

Link to the basic patent

A link to the basic patent of the SPC or paediatric SPC is available in the results list and in the detailed view.

Publication details

Publication details can only be searched for after the electronic publication. Older publication dates only appear in the detailed view with the publication number and year. However, they cannot be used as search criteria.

Designs

What kind of data does Swissreg contain? What types of data are not included?

Swissreg contains designs that are entered in the Swiss register as well as cancelled designs after they have been published. Design applications are not shown.

Swissreg is a tool for carrying out online searches for design rights that have been granted and entered in the register of the IPI and published. Swissreg is primarily intended for general information. For a complete and reliable basis for your decisions, we recommend having a professional search carried out.

International design applications designating Switzerland

Design applications designating Switzerland filed with the World Intellectual Property Organization (WIPO) are not in the Swissreg database. They can be found on the WIPO website after they have been published: http://www.wipo.int/ipdl/en/search/hague/search-struct.jsp

Publication dates

Publication dates as of 13 November 1981 can be retrieved in Swissreg. Designs numbered 112,001 and higher are included in the database.

Results list

No more than 500 results will be displayed. If your search results in more than 500 matches, then 500 will be randomly displayed with the following exception: if the “publication date” is used as the search term, all entries for that date will be displayed.
